2. Use of Our Website

4. Quotes and Project Agreements

All project quotes and proposals are valid for 30 days unless otherwise stated.

Project scope, pricing, timelines, and deliverables will be outlined in written agreements, proposals, invoices, or email correspondence.

Changes requested outside the original project scope may result in additional fees.

5. Payments

Payment terms will be specified within project proposals, invoices, or service agreements.

Unless otherwise agreed:

  • Deposits are non-refundable once work has commenced.

  • Final deliverables may not be released until outstanding balances have been paid in full.

  • Late payments may result in project delays or suspension of services.

6. Client Responsibilities

Clients are responsible for providing:

  • Accurate information

  • Required content and materials

  • Timely feedback and approvals

  • Appropriate permissions for any supplied content

Maldek Media is not responsible for delays resulting from incomplete information, delayed responses, or failure to provide required materials.

7. Website Launch and Maintenance

Upon project completion and final payment, responsibility for website content, updates, and ongoing maintenance transfers to the client unless a separate maintenance agreement is in place.

While we strive to provide reliable services, we cannot guarantee uninterrupted website availability or performance due to factors beyond our control, including third-party hosting providers and software platforms.

8. Third-Party Services

Projects may involve third-party platforms or services, including but not limited to:

  • Wix

  • Google

  • Meta/Facebook

  • Instagram

  • YouTube

  • Domain registrars

  • Hosting providers

Maldek Media is not responsible for outages, policy changes, pricing changes, or service interruptions caused by third-party providers.

9. Limitation of Liability

To the fullest extent permitted by law, Maldek Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.

Our total liability for any claim related to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

10. Project Portfolio Rights

Unless otherwise agreed in writing, Maldek Media reserves the right to display completed projects, designs, branding work, websites, and related materials within our portfolio, website, social media channels, and promotional materials.

  • Payments remain outstanding

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Ontario, Canada.
